The recent ransomware attack against a prominent eDiscovery service provider should remind us all that there are only two types of companies: those that have already been hacked and those that will be hacked in the future. Just as we are all told to “make a plan” in advance of an emergency, it is imperative that corporations and law firms alike revisit their service provider relationships and implement safeguards and contingency plans to ensure eDiscovery continuity the next time disaster strikes.

Protective orders and ESI protocols should also impose information security mandates on the recipients of sensitive client data. Panelists will discuss the steps they have already taken, and those they are presently evaluating, to protect their data and maintain eDiscovery operations in the event of a service provider hack.
